These Terms of Service apply to the use of the Mega Motion Design website and to services provided by Mega Motion Design.

By using our website, submitting an enquiry, accepting a quote or engaging our services, you agree to these terms.

Services

Mega Motion Design provides motion graphics, animation, video design and related creative production services.

Services may include, but are not limited to:

  • Corporate video graphics

  • Logo animation

  • Social media motion graphics

  • Explainer animation

  • Video titles and lower thirds

  • Branded motion graphics packages

  • White-label agency support

The exact scope of each project will be outlined in a quote, proposal, email agreement or written project brief.

Quotes and project scope

All quotes are based on the information provided at the time of quoting.

Unless otherwise agreed in writing, a quote will include:

  • The agreed deliverables

  • Project timeline

  • Number of included revision rounds

  • File formats or exports

  • Any specific inclusions or exclusions

Additional work outside the agreed scope may be quoted separately or charged at an agreed hourly rate.

Revisions

Projects include the number of revision rounds stated in the quote or project agreement.

Revisions must relate to the agreed project scope. Major changes in direction, new concepts, additional deliverables or changes requested after approval may be treated as additional work.

Client responsibilities

To complete the project, you agree to provide required materials in a timely manner. This may include scripts, brand guidelines, logos, fonts, video files, images, reference material, feedback and approvals.

Delays in providing content, feedback or approvals may affect the project timeline.

Payments

Payment terms will be outlined in the quote, invoice or written agreement.

Depending on the project, we may require:

  • A deposit before work begins

  • Progress payments

  • Final payment before delivery of final files

  • Payment upfront for smaller projects

  • Hourly, day-rate or monthly support billing

Late payments may result in project delays, paused work or withheld final files until payment is received.

Cancellations

If a project is cancelled after work has started, you may be charged for work completed up to the cancellation date, including planning, design, animation, project management and any external costs already incurred.

Deposits may be non-refundable unless otherwise agreed in writing.

Ownership and usage rights

Unless otherwise agreed in writing, final approved deliverables become available for your use once full payment has been received.

Working files, project files, After Effects files, drafts, unused concepts and internal production materials are not included unless specifically stated in the quote or agreement.

Mega Motion Design retains ownership of underlying processes, templates, methods, tools, project structures and know-how used to create the work.

Client-supplied materials

You confirm that you have the right to use any materials you provide to us, including logos, images, videos, music, fonts, scripts, brand assets and third-party content.

You are responsible for ensuring that client-supplied materials do not infringe the rights of any third party.

Third-party assets

Some projects may require stock footage, music, fonts, plugins, templates, images or other third-party assets.

Any required third-party licence costs will either be included in the quote or billed separately, depending on the project.

Portfolio use

Unless you request otherwise in writing, Mega Motion Design may display completed work in our portfolio, website, social media, showreel or marketing materials.

For confidential or white-label agency projects, we can agree in writing not to publicly display the work.

Limitation of liability

To the maximum extent permitted by law, Mega Motion Design is not liable for indirect, incidental or consequential loss, including loss of profit, loss of business, loss of data or reputational damage.

Our liability for any claim relating to our services is limited to the amount paid for the relevant service, except where the law does not allow such limitation.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or other applicable laws. Businesses must not mislead consumers about their rights, and consumer guarantees can apply to services sold in Australia.

Changes to these terms

We may update these Terms of Service from time to time. The latest version will be published on this website.
